Terms of Service

1. Acceptance of Terms
By accessing or using ListingCopy.ai (“the Service”), operated by ListingCopy (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a brokerage, team, or other organization, you represent that you have the authority to bind that organization to these terms.
2. Description of Service
ListingCopy is an AI-powered platform that generates real estate marketing content, including but not limited to: MLS listing descriptions, social media ad copy, email marketing content, SMS copy, key selling points, hashtags, Fair Housing compliance reports, property photo analysis, and content translations. The Service uses artificial intelligence models (currently Anthropic's Claude) to generate content based on property information you provide.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate and complete registration information. You must be at least 18 years old to create an account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Billing
ListingCopy offers Free, Agent ($29/month), and Team ($79/month) subscription plans. The Free plan includes 3 listing generations per month. The Agent plan includes 25 listing generations per month. The Team plan includes unlimited listing generations and up to 5 team member accounts.
Paid subscriptions are billed monthly through Stripe. You authorize us to charge your payment method on a recurring basis. Subscription fees are non-refundable except as required by applicable law. You may cancel your subscription at any time; access continues until the end of the current billing period. Listing generation counts reset at the start of each billing cycle. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
5. Content Ownership and License
5.1 Your Input Data
You retain ownership of all property information, photos, and other data you provide to the Service (“Input Data”). By providing Input Data, you grant us a limited, non-exclusive license to process that data for the purpose of generating content and providing the Service. This license terminates when you delete the data or your account.
5.2 Generated Content
You own all content generated by the Service based on your Input Data (“Generated Content”). You are free to use, modify, publish, and distribute Generated Content without restriction. We claim no ownership interest in Generated Content. However, you acknowledge that similar or identical content may be generated for other users who provide similar property data, and this does not constitute infringement of your rights.
5.3 No Exclusivity
Generated Content is not guaranteed to be unique. The AI model may generate similar phrasing, structures, or descriptions for properties with similar characteristics. You are responsible for reviewing and customizing Generated Content before publication.
6. AI-Generated Content Disclaimer
IMPORTANT: All content generated by ListingCopy is produced by artificial intelligence and should be treated as a first draft. You are solely responsible for reviewing, editing, and approving all content before publication or use in any marketing materials.
AI-generated content may contain inaccuracies, including but not limited to: incorrect property descriptions, factual errors about features or amenities, inappropriate claims about property condition or value, and language that may not comply with local MLS rules or regulations. You must verify all Generated Content against actual property conditions before use.
We do not guarantee the accuracy, completeness, or suitability of any Generated Content for any particular purpose. Use of Generated Content is entirely at your own risk.
7. Fair Housing Act Compliance
IMPORTANT FAIR HOUSING DISCLAIMER: ListingCopy's Fair Housing compliance check is an AI-powered screening tool designed to identify potentially problematic language. It is NOT a substitute for legal advice, broker review, or professional Fair Housing compliance counsel.
While our system is designed to flag language that may violate the Fair Housing Act (42 U.S.C. sections 3601-3619) and related state and local fair housing laws, we do not guarantee that Generated Content is fully compliant with all applicable fair housing laws and regulations. The compliance check may not catch every potential violation, and standards may vary by jurisdiction.
You are solely responsible for ensuring that all marketing materials you publish — whether generated by ListingCopy or written independently — comply with the Federal Fair Housing Act, state fair housing laws, local ordinances, and your MLS rules and regulations. We strongly recommend having your broker or a qualified attorney review all listing marketing materials before publication.
ListingCopy shall not be held liable for any Fair Housing complaints, fines, penalties, or legal actions arising from the use of Generated Content, regardless of whether the content passed our compliance check.
8. Photo Analysis and Data Handling
When you upload property photos for AI analysis, you represent that you have the right to use those photos and submit them for AI processing. This may include photos taken by professional photographers under your contract — you are responsible for ensuring your photographer's agreement permits AI processing.
Photos uploaded for analysis are processed in real-time and are not permanently stored on our servers. AI-identified features should be verified against actual property conditions before being included in marketing materials. We are not responsible for features incorrectly identified or missed by the AI analysis.
9. Acceptable Use
You agree not to use the Service to:
- Generate content for properties you do not have authorization to market
- Create intentionally misleading or fraudulent property descriptions
- Generate content that intentionally violates Fair Housing laws
- Circumvent usage limits through multiple accounts or automated access
- Reverse engineer, decompile, or attempt to extract our AI prompts or system configurations
- Resell or redistribute Generated Content as a competing service
- Use the Service for any unlawful purpose
- Attempt to disrupt or overload the Service through automated means
10. MLS Compliance
You are responsible for ensuring that Generated Content complies with your local MLS rules and regulations, including but not limited to: character limits, required disclosures, prohibited language, formatting requirements, and any MLS-specific rules regarding AI-generated content. Some MLS systems may require disclosure that content was AI-generated. You are responsible for checking and complying with your MLS requirements.
11. Team Accounts
Team plan subscribers may invite up to 5 team members. The account owner is responsible for all team member activity and compliance with these Terms. Team members have access to the shared workspace and generation features. The account owner may remove team members at any time. If a team member leaves the organization, the account owner should remove their access promptly.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTINGCOPY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR: ANY DAMAGES ARISING FROM FAIR HOUSING COMPLAINTS RELATED TO GENERATED CONTENT; INACCURACIES IN AI-GENERATED PROPERTY DESCRIPTIONS; ERRORS IN AI PHOTO ANALYSIS; MISSED FAIR HOUSING LANGUAGE VIOLATIONS; OR ANY CONSEQUENCES OF PUBLISHING GENERATED CONTENT WITHOUT ADEQUATE REVIEW.
13. Indemnification
You agree to indemnify and hold harmless ListingCopy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from: your use of the Service; your publication of Generated Content; any Fair Housing complaints related to content you published; your violation of these Terms; or your violation of any third-party rights.
14. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance. Unused listing generations do not roll over between billing periods.
15. Termination
You may terminate your account at any time by canceling your subscription and deleting your account. We may terminate or suspend your account if you violate these Terms, engage in abusive behavior, or fail to pay subscription fees. Upon termination, your access to the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted (except billing records required by law).
16. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Delaware. You agree to submit to the personal jurisdiction of such courts.
17. Changes to Terms
We may modify these Terms at any time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with changes, you may cancel your account before the effective date.
